On 6th April 2008, new legislation came into effect, (Corporate Manslaughter and Corporate Homicide Act 2007) which means that owners / directors of any business or organisation can be found guilty of corporate manslaughter as a result of serious management failure giving rise to gross breach of duty of care.

As Duty of Care is a fundamental part of all Health & Safety Legislation, it now means that owner / directors can be found guilty of manslaughter for a serious failure of health and safety systems within their organisation, which lead to a fatality. It is no longer possible to pass the responsibility of any failures to lower management, it is therefore even more important than ever that you set up a dedicated and maintained Health & Safety System, specific for your operation.
