In Europe, trademarks may be registered within individual countries, or across the whole of the European Union by means of a Community Trade Mark Registration. A Community Trade Mark (CTM) is a single European trademark registration that protects your trade mark in all 27 Member States of the European Union. The most attractive feature of CTM registration is that it offers trade mark protection in all the Member States of the EU at a cost that is much lower than that of filing separate trademark applications in each Member State. Moreover, it is a much simpler procedure, compared to submitting national applications in each Member State. The CTM application need only be submitted in one language, and only one payment of fees needs to be made. The CTM system is administered by the Office for Harmonisation in the Internal Market (OHIM), based in Spain.
Furthermore, the management of a trade mark portfolio is much easier with a CTM than with a series of registered trademarks across the EU; most businesses would rather keep an eye on one renewal date than 27. Also, unlike many national marks, use of the trademark is not required to secure registration or renewal. Although a CTM can in theory become vulnerable to cancellation after a five-year consecutive period of non-use, use of the trademark on a reasonable scale in a single Member State is normally sufficient to maintain the validity of the CTM registration throughout the EU.
National European trademark systems still operate alongside the CTM system. However, if you are trading in more than one country of the EU, the CTM European trademark registration system is probably the most cost-effective means by which to protect your trade mark. The CTM system is much cheaper than obtaining and renewing up to 27 separate national trademark registrations to cover all the EU member states.
A CTM European trademark registration is valid for an initial period of 10 years and, subject to payment of renewal fees, can be renewed for further 10-year periods thereafter.
