A free basic guide on the legal responsibilities of fire risk assessors has been released which outlines many of the legal pitfalls that the commercial fire risk assessor, or their employer, may be exposed to under criminal or civil law. The documentation includes sections on Liability under Criminal Law, Liability for Breach of Contract, Liability in Tort and Potential Breaches by a Fire Risk Assessor. A key fact to be noted is that if breaches occur then it could lead to prosecution which, if found guilty, can result in large fines and/or imprisonment. An example of this is: A risk assessor who had failed to carry out suitable and sufficient risk assessments at two premises was sentenced to 8 months imprisonment (reduced from 12 months for an early guilty plea) and was ordered to pay £5,862 towards the costs of the prosecution. An appeal against sentence was refused and the Court of Appeal stated: “We emphasise, as did the Judge, the importance of the role of assessors under the 2005 Order. People’s lives depend upon it. The importance of the role is emphasised by the fact that the 2005 Order provides for sentences of imprisonment to be imposed…” Here at Vulcan Fire Training we provide businesses with professional training that allows them to comply with the fire safety regulations, which - if then implemented correctly - should ensure that they avoid any fines and imprisonment; but more importantly it will make the workplace a safer place and potentially save lives.
