CHANGES FOR LANDLORDS TO HSE LEGISLATION ON CONTROL OF LEGIONNAIRES DISEASE The health and safety executive has recently updated legislation regarding the control of legionnaires disease. The revision means the legislation now applies to all residential lettings, which was not covered previously. HEALTH AND SAFETY ACT 1974 (HSWA). All residential properties which are rented out , must now have a RISK ASSESMENT undertaken to determine the risk of legionella which then allows the landlord to implement a suitable scheme. Legionella are bacteria which are common in natural (rivers and lakes etc) and artificial water systems, eg hot and cold water systems (storage tanks,pipework,taps and showers) WHO WILL IT COVER ? As a landlord , under health and safety law ,it is your duty to take suitable precautions to prevent or control the risk of exposure to legionella. WHAT NEEDS TO DE DONE ? Landlords/Letting agents must ensure a risk assessment is carried out to help establish potential risks and implement measures to either eliminate or control risk of exposure to legionella’s. To carry out this assessment and to identify these risks in the water systems a competent person who understands water systems and any associated equipment should establish and possible exposure to legionella risks as part of the risk assessment. The risk assessment should include • Management responsibilities, including the name and signature of the competent person and a description of the system • And potential Risk sources • Any control measures currently in place to control Risks • Monitoring, inspection and maintenance procedures • Records for monitoring results, inspection and checks carried out and a review date (we suggest annual checks) If its decided that the risks are insignificant and are being properly managed to comply with the law , the assessment is complete. Its important however to review the assessment periodically in case anything changes. SUMMARY • Updates to the health and safety executive state that all rental properties must have had a legionella’s risk assessment carried out by a competent person, who understands water systems. • Risk assessment, description of system, record log must be kept for each rented property • HSE are the enforcing body and can issue fines up to £20,000 to landlords who have not had their properties checked for legionella’s Legionella's testin from £99.00+vat
